Terms and Conditions – Marly Design

1. General
These terms and conditions apply to all offers, orders, and agreements between Marly Design, hereinafter referred to as "seller," and the consumer or business customer, hereinafter referred to as "buyer." Deviations from these terms are only valid if agreed upon in writing.

2. Offers and prices
All offers are non-binding unless explicitly stated otherwise. The prices stated include VAT and exclude any shipping costs, unless otherwise indicated. Errors in pricing or product information may be corrected by the seller.

3. Formation of the agreement
An agreement is formed at the moment the buyer places an order and it is confirmed by the seller via email. The seller reserves the right to refuse an order, for example, in case of doubt regarding payment or delivery options.

4. Payment
Payment can be made via the methods offered by the seller, such as iDeal, credit card, PayPal, or bank transfer. The buyer must pay within the period stated on the invoice.

5. Delivery and transfer of risk
Delivery takes place in accordance with the delivery times indicated by the seller. The risk of loss or damage to the product passes to the buyer at the moment of delivery to the delivery address provided by the buyer.

6. Ownership
The product remains the property of the seller until full payment, including any costs, has been received.

7. Right of withdrawal
Consumers have the right to dissolve the agreement within 14 days of receiving the product without providing any reasons. The full procedure is described on the returns page.

8. Liability
The seller is only liable for direct damage demonstrably caused by intent or gross negligence on the part of the seller. Liability for indirect damage, consequential damage, or lost profits is excluded to the extent permitted by law.

9. Warranty
The legal warranty applies to products delivered by the seller. Any additional warranties are stated with the product.

10. Complaints procedure
Complaints about products or services can be submitted via the contact page. Complaints will be handled carefully and within a reasonable timeframe.

11. Applicable law and disputes
Dutch law applies to all agreements. Any disputes shall be submitted to the competent court in the district where the seller is established.
